In 2023, the United States Supreme Court issued opinions significantly limiting affirmative action policies in university admission programs.  Immediately in response, plaintiffs’ lawyers began suing large companies claiming that Diversity, Equity, and Inclusion programs constitute unlawful discrimination.  The EEOC has said that DEI programs do not constitute unlawful discrimination, even after the Supreme Court’s decisions.  What should an employer do?  Eliminate its DEI programs?  Modify them?  Sean and Mike will discuss the latest Supreme Court decisions and explore what options employers have with regard to DEI moving forward.
